Cobalt Successful for Berlin-Chemie in Trademark Dispute Before Lithuanian Supreme Court

Cobalt has successfully represented Berlin-Chemie before the Supreme Court of Lithuania in a trademark dispute concerning the parallel import of medicinal products.

According to Cobalt, the case centered on whether a parallel importer was entitled to rename a medicinal product imported from another EU member state using a trademark registered and employed by Berlin-Chemie in Lithuania. The claimant argued that such renaming infringed its trademark rights and sought injunctive relief, market withdrawal, damages, and costs. The Supreme Court upheld the decisions of the lower courts, concluding that the importer had not justified the necessity of the renaming and ordered the cessation of the infringing actions.
