Popovici Nitu Stoica & Asociatii has successfully represented Auchan Import Export Roumanie before Romania's High Court of Cassation and Justice in a dispute against the country's National Agency for Fiscal Administration regarding approximately EUR 2 million in additional profit taxes.
According to the firm, the court invalidated all fiscal-administrative documents in contention regarding the EUR 2 million in additional profit taxes that ANAF had established for Auchan. The agency had done so by deeming the company's financial reporting, trade marketing, and logistics costs towards affiliated companies as non-deductible.
The dispute spanned a seven-year period and the High Court of Cassation and Justice ultimately admitted Auchan's action in full, requiring ANAF to repay the disputed amount and related fiscal interest, totaling approximately EUR 2 million, PNSA reported.
