Eversheds Sutherland has successfully represented Altrad-Mostostal before the President of the Office of Competition and Consumer Protection regarding payment gridlocks.

According to Eversheds Sutherland, “the case concerned the so-called payment gridlocks, i.e. excessive delays in paying remuneration to contractors. In December of 2020, the President of the Office of Competition and Consumer Protection initiated proceedings against Altrad-Mostostal. As part of the proceedings, [Eversheds Sutherland] managed to prove that the reason for the payment gridlock – which would normally result in imposing a financial penalty on the client – was the fact that Altrad-Mostostal was itself a victim of payment gridlocks. Thus, the President of OCCP had to refrain from imposing the fine and content himself with instructing the company on its obligations.”

Eversheds Sutherland’s team was led by Senior Associate Dariusz Aziewicz.
