TGS Baltic Secures Victory in Abuse of Dominance Case Against LDZ Cargo

TGS Baltic has successfully represented LDZ Cargo and its parent company in overturning a EUR 5.7 million fine imposed by the Latvian Competition Council for alleged abuse of dominant position in the rail freight sector.

According to TGS Baltic, the Administrative Regional Court fully annulled the Competition Council’s decision, rejecting findings that LDZ Cargo had engaged in loyalty-inducing pricing and imposed unjustified charges for idle privately-owned wagons on public rail infrastructure. The court concluded that the Competition Council failed to substantiate the scope and effects of the alleged conduct and had misinterpreted key facts while also breaching procedural safeguards.
